No, it isn’t. The subdomain is in use on an account from someone else. As long as this account is being used, this other person is free to hold on to the domain.
Domains are registered on a first come, first served basis. If someone else registers a domain name you would like to use before you can register it, you can’t use it. That’s sad, especially if the domain name is not actually being used. But we’re not going to steal domains from active accounts, just because the domain doesn’t serve a website right now.
